Acceptance of these terms
These Terms of Use (“Terms”) govern your use of https://aproksha.com and any related public-facing content (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms govern your use of the Site only. Engagements with Aproksha for paid services are governed by a separate Master Services Agreement (MSA), Statement of Work (SOW), and Data Processing Addendum (DPA) where applicable.

Who we are
Aproksha is an AI implementation studio headquartered in Amaravathi, Andhra Pradesh, India. We design, build, and operate AI systems for businesses. The Site exists to describe our work, share what we build, and let prospective clients reach us.

Permitted use of the Site
You may:
- View, read, and share links to public pages of the Site.
- Quote short excerpts with attribution and a link back.
- Use our public materials for evaluation purposes related to engaging us.
You may not:
- Scrape, crawl, or systematically extract content beyond what a normal browser does.
- Reverse engineer, decompile, or attempt to derive the source of any system we run.
- Train AI models on the Site's content without our written permission.
- Use the Site to send spam, malware, or harassing content.
- Interfere with the Site's availability for other users.
- Misrepresent yourself as Aproksha or as affiliated with us.

Intellectual property
All content on the Site, including text, graphics, the Aproksha mark and wordmark, design system, photographs, illustrations, code, and Labs product previews, is owned by Aproksha or licensed to us, and protected by copyright, trademark, and other laws.
We grant you a limited, non-exclusive, non-transferable license to view and use the Site for personal and lawful business purposes consistent with these Terms. Nothing in these Terms transfers any ownership to you.
Open-source code we publish under our GitHub organization is governed by the license of the relevant repository.

Submissions and feedback
If you send us a contact form submission, email, idea, or feedback (“Submissions”):
- You confirm you have the right to send it.
- You grant us permission to read, store, and respond to it.
- For unsolicited business ideas, you grant us a non-exclusive, royalty-free, perpetual license to use the idea, with no obligation to compensate you. If you want a confidential discussion, sign an NDA with us first.

No professional advice
The Site provides general information about Aproksha and the work we do. It is not legal, financial, medical, regulatory, or other professional advice. Decisions you make about your business should be informed by qualified advisors and your own judgment, not by content on this Site.
Where the Site references AI capabilities (for example: “our AI agent handles customer support”), those statements describe what we have built or can build for clients. They do not constitute promises about results in your specific environment without a written agreement.

AI-generated content disclaimer
AI systems can produce inaccurate, biased, or unexpected output. Where we publish content created with AI assistance, we review it before publishing, but no system, including ours, is perfect.
If you use AI tools that we publicly demonstrate, do so with appropriate human review. Do not rely on AI output for high-stakes decisions without independent verification.

Third-party links and services
The Site may link to third-party websites, services, and resources. We do not control them, do not endorse their content, and are not responsible for them. Your use of third-party sites is governed by their own terms.

Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties: express, implied, and statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or use of trade.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We make no warranties about the accuracy, reliability, or availability of any content.

Limitation of liability
To the maximum extent permitted by law, Aproksha and its founders, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Site.
Our total liability for any claim arising out of or relating to the Site is limited to one hundred Indian rupees (₹100) or the maximum amount allowed by applicable law, whichever is lower. This limit does not apply to liabilities that cannot be excluded by law.
Different liability terms apply to paid engagements, and are governed by the relevant MSA / SOW.

Indemnification
You agree to defend, indemnify, and hold harmless Aproksha and its founders, employees, and agents from any claim, loss, damage, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

Governing law and jurisdiction
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site is subject to the exclusive jurisdiction of the courts at Vijayawada, Andhra Pradesh, India.
Where you are entitled by mandatory local consumer protection law to a different forum or law, that mandatory protection applies.

Changes to these Terms
We may update these Terms from time to time. When we do, we update the “Effective” date at the top. Continued use of the Site after a change means you accept the updated Terms.
